HERE’S THE LEGAL BACKBONE:

• • The “True Threat” or “Incitement” Standard: Under the First Amendment, political rhetoric and abstract advocacy of violence are protected speech. Prosecutors must prove the broadcast was a “true threat” or constituted an immediate incitement to lawless action.

• Corroborating Evidence: Under federal law (18 U.S.C. § 373), a solicitation charge requires strong corroborating circumstances showing that the speaker truly intended for the crime to be carried out, rather than engaging in idle chatter, hyperbole, or political theater.

BOTTOM LINE: Presidential immunity doesn’t give Trump a pass to commit murder, but it creates a strong legal shield depending on whether the act is official or private.

Private Acts

• No immunity: A president has zero immunity for private, personal crimes.
• The “Fifth Avenue” rule: If a president shoots someone for a personal reason, regular murder laws apply.
• Prosecution: They can be arrested & tried in a normal criminal court for private acts.
